8(b)(i)
All fence plans must be approved by the Approving Party and the City prior to installation.
Only wrought iron (or similar) fences in the specific style and color approved by the Approving Party shall be permitted on the Golf Course Lots; provided, however, that wood fences shall be allowed on a Golf Course Lot around a patio area.
Only wood or wrought iron (or similar) fences or privacy screens in the specific styles and colors approved by the Approving Party shall be permitted on Lots other than Golf Course Lots.
All fences, boundary walls and privacy screens shall be ornamental and shall not disfigure the property or the neighborhood or interfere with drainage.
All fences and privacy screens shall be constructed with the finished side out.
No chain link, wire or similar fence shall be permitted.
Unless and until otherwise specifically approved in writing by the Approving Party,
(A) no fence, boundary wall or privacy screen shall exceed five feet in height
(B) no fence, boundary wall or privacy screen shall be constructed or maintained on any Lot nearer to the front street than the rear comers (as determined by the Approving Party) of the residence
(C) no fence shall be constructed or maintained on any Lot more than one foot &om the property line of the Lot, except to the extent necessary for such fence to abut the residence and except for fences around swimming pools and patio areas
D) all perimeter fences must be joined to or abutting any previously existing fences on adjacent lots
E) all fences shall be stair-stepped to follow the grade of the Lot, and no wood fence shall be painted or stained.
21(c)
No fence installed by or for the Developer along the boundary between the Golf Course and the Golf Course Lots may be altered or removed by or for the Owner of the Golf Course Lot.
Once installed, the Owner of each applicable Golf Course Lot shall be responsible for the proper maintenance, repair and replacement (as necessary) of such fence to the extent on such Owner's Lot.
